As our client you will receive:
  • Verification of claimant's Medicare status and analysis of whether approval or some other protective measure is required.

  • Medical analysis by a registered nurse of claimant's future medical needs for determination of the required length of care. 

  • Projection of claimant's annual medical costs and total future lifetime costs related to the industrial injury.

  • Annuity pricing, if necessary, and recommendations on the most cost-effective manner for funding the settlement using a combination of annuities and lump sum cash payments.

  • A legal opinion analyzing the specific facts of each case.  If formal CMS approval is required, the opinion will set forth various funding and settlement options to minimize the cost of the settlement and expedite the approval process.

  • A legal opinion recommending the most effective method of settlement which provides the client maximum protection from future Medicare claims regardless of whether formal CMS approval is required.

  • Draft settlement documents with Medicare language, based upon the specific facts of the case.

  • A proposal to CMS to obtain approval of the settlement.  The proposal may contain arguments to reduce the amount required to be set aside due to various legal or medical issues.

  • Negotiations with CMS by an experienced attorney.

  • Ongoing dialogue with an MSP Solutions representative regarding the status of each claim.
